Rules for med spa marketing in Illinois
Illinois regulators have addressed med spas directly. A memo from the Department of Financial and Professional Regulation (IDFPR) and the Department of Public Health, updated October 30, 2025, sets out who may own a med spa, how procedures are delegated and how lasers are regulated.
Who can own a med spa
- IDFPR says the Medical Practice Act and the Nurse Practice Act require med spas to be owned and operated by physicians, and for some services by APRNs, because the services are medical services.
- A corporate entity operated by a physician may generally have only physicians as shareholders or members, officers, directors or managers, and one operated by an APRN only APRNs. Someone who is neither cannot hold those roles.
- A cosmetology or esthetics salon registration cannot be used to operate a med spa, and salons may not use "medical" or a similar term in their business name.

- IDFPR lists Botox, chemical peels other than superficial peels, collagen injections, microneedling and radiofrequency among the procedures that are the practice of medicine and outside the scope of cosmetologists and estheticians.
- Physicians may delegate to nurses and other trained staff within a physician-patient relationship. Delegating to an unlicensed person in an office setting requires a licensed health care professional on site. An esthetician employed by a med spa may not present a delegated medical procedure as esthetics.

- Laser, intense pulsed light, radiofrequency and medical microwave treatments that disrupt the skin's surface are the practice of medicine. A physician must examine the patient and set a course of treatment before the first procedure.
- Ablative procedures may be delegated only with the physician on site. Non-ablative procedures require on-site supervision or a physician available by phone or electronically, and anyone performing them needs documented training on each device.
- Since January 1, 2025, a laser hair removal facility that follows a physician delegation protocol may have an APRN perform the pre-treatment exam, with a trained RN or LPN performing the procedure and a physician available by phone or electronically.
