Rules for med spa marketing in Massachusetts

Massachusetts treats Botox, fillers, chemical peels and laser, light and radiofrequency treatments as medical services. The Department of Public Health requires clinic licensure for a med spa unless its practitioners wholly own and control it, and the medicine, nursing and cosmetology boards each set limits on who may perform which services and how they may be advertised.

Ownership and clinic licensure

  • The Department of Public Health says a medical spa that provides medical services must be licensed as a clinic unless it is wholly owned and controlled by one or more of the practitioners who provide its medical services. The statutory exemption also requires that the name not use the words "clinic," "institute" or "dispensary."
  • The advisory lists laser, light and radiofrequency devices, chemical peels, soft tissue fillers, botulinum toxin and sclerotherapy as examples of medical services, and says any business that offers them is subject to clinic licensure unless it is exempt.

Injectables and nurse-performed procedures

  • The Board of Registration in Medicine prohibits delegating medical services to anyone who is not licensed to perform those services in Massachusetts (243 CMR 2.07(4)).
  • The Board of Registration in Nursing's Advisory Ruling 13-01 says RNs and LPNs may administer botulinum toxin, hyaluronic acid and absorbable fillers, and perform chemical peels, pursuant to the orders of a duly authorized prescriber. Nurses who are not APRNs with prescriptive authority may not select the product, dose, device or device setting.
  • Nurses may practice cosmetic procedures only in organizations whose policies require informed consent, a documented evaluation by an authorized prescriber, and plans for side effects, referral and emergencies. The ruling also treats microneedling and dry needling as acupuncture, which requires a Massachusetts acupuncture license.

Lasers and what aestheticians may not do

  • Under Advisory Ruling 13-01, RNs and LPNs may perform non-ablative laser and light procedures, such as hair removal and photo rejuvenation, after completing a laser physics and safety course. Ablative laser procedures are limited to Board-authorized APRNs, and settings that use lasers must license the laser with Massachusetts Radiation Control.
  • The Board of Registration of Cosmetology and Barbering bars cosmetologists and aestheticians from injections, laser use (except by electrologists), radiofrequency, body contouring and microneedling that invades the dermis. Aestheticians may use intense pulsed light for hair removal and photofacials under a separate Board policy, and a physician's delegation does not bring medical services under a cosmetology license.

  • 243 CMR 2.07(11) allows physicians to advertise by means that are in the public interest. That excludes advertising that is false, deceptive or misleading, that guarantees a cure, or that claims professional superiority the licensee cannot substantiate. An ad with fixed prices or a price range must clearly state whether additional charges may apply.
  • Physicians must keep a complete, reproducible copy of print and electronic advertising for three years and include their name, business address and degree (M.D. or D.O.) in an advertisement or professional notice.
  • Cosmetology licensees may not advertise delegated medical services as operating under their license or use a title such as "medical aesthetician," which the Board says does not exist under the law.
